Waste Clearance Barnes Service Terms and Conditions

These Terms and Conditions set out the basis on which Waste Clearance Barnes provides waste clearance and related services. By making a booking or allowing our team to carry out any work, you agree to be bound by these Terms and Conditions. Please read them carefully before placing an order for any waste collection or clearance service.

1. Definitions

In these Terms and Conditions, the following expressions have the following meanings:

1.1 Client means the individual, business, or organisation purchasing or receiving services from Waste Clearance Barnes.

1.2 Services means waste clearance, rubbish removal, bulky item collection, house or office clearance, garden waste removal, and any associated labour or transport carried out by Waste Clearance Barnes.

1.3 Agreement means the contract formed between the Client and Waste Clearance Barnes once a booking is accepted and confirmed.

1.4 Site means the property, premises, or location where the Services are to be carried out.

1.5 Waste means items and materials presented by the Client for removal, including household, commercial, garden, and bulky waste, but excluding any waste types listed as prohibited in these Terms.

2. Scope of Services

2.1 Waste Clearance Barnes provides waste removal and clearance services within its operating area, which may be amended from time to time at its discretion.

2.2 Services may include loading, removal, transportation, and disposal or recycling of waste, as agreed at the time of booking and subject to applicable waste regulations.

2.3 The quantity and type of waste to be removed are normally assessed based on the information provided by the Client in advance and any on-site inspection carried out by our team on arrival.

2.4 Waste Clearance Barnes reserves the right to decline or discontinue Services if it discovers, at any stage, that the waste type, volume, or Site conditions differ substantially from what was described at the time of booking, or if it considers the conditions to be unsafe or non-compliant with applicable regulations.

3. Booking Process

3.1 A booking may be requested by telephone, email, or any other method approved by Waste Clearance Barnes.

3.2 When making a booking, the Client must provide accurate and complete information, including but not limited to:

(a) The address of the Site and any access requirements or restrictions.
(b) The approximate volume, type, and description of waste.
(c) Any special handling requirements or potential hazards.
(d) Any parking or loading constraints that may affect the provision of Services.

3.3 Any quotation provided prior to arrival is based on the details supplied by the Client and is an estimate only. The final price may be adjusted if, upon inspection, the actual waste volume, type, or access conditions differ from the initial description.

3.4 A booking is only accepted and confirmed when Waste Clearance Barnes has issued a confirmation verbally or in writing. The Agreement is formed at the point of such confirmation.

3.5 Waste Clearance Barnes reserves the right to refuse a booking at its sole discretion.

4. Access and Client Obligations

4.1 The Client must ensure that reasonable access is provided to the Site at the agreed time of collection. This includes arranging for any necessary permits, keys, codes, or authorisation needed to access the relevant areas.

4.2 The Client must ensure that all waste to be removed is clearly identified and separated where necessary. If any items are not to be removed, the Client is responsible for clearly indicating or segregating such items.

4.3 The Client warrants that they have full authority to allow Waste Clearance Barnes to remove the waste from the Site and that the removal of such waste does not infringe any third-party rights.

4.4 The Client must ensure that the Site is safe for our personnel to work on. Waste Clearance Barnes may refuse or suspend Services if it considers the Site to be unsafe, if there is a risk to health and safety, or where conditions prevent the safe loading and removal of waste.

5. Pricing and Payments

5.1 Pricing is generally based on the volume and type of waste, labour involved, and any additional services required, such as dismantling, heavy lifting, or extra time on Site.

5.2 Unless otherwise stated, all prices are quoted in pounds sterling and may be subject to applicable taxes.

5.3 Any price provided prior to the commencement of work is an estimate and may be revised when our team completes an on-site assessment. The Client will be informed of any change in price before work proceeds.

5.4 Payment is due on completion of the Services unless otherwise agreed in writing. Waste Clearance Barnes may, at its discretion, require full or partial payment in advance.

5.5 Accepted payment methods may include cash, bank transfer, and card payment, subject to availability. The Client is responsible for ensuring that funds are available and that any card or account details provided are valid and authorised.

5.6 For business Clients with pre-agreed credit terms, invoices are payable within the period specified on the invoice. Waste Clearance Barnes reserves the right to charge interest on late payments in accordance with applicable UK legislation.

6. Cancellations and Rescheduling

6.1 The Client may cancel or reschedule a booking by giving reasonable notice. Waste Clearance Barnes requests at least 24 hours notice for cancellation or rescheduling wherever possible.

6.2 If the Client cancels a booking with less than 24 hours notice, Waste Clearance Barnes reserves the right to charge a cancellation fee to cover administrative and scheduling costs, as reasonably determined.

6.3 If our team attends the Site at the agreed time and is unable to carry out the Services due to lack of access, incorrect information, health and safety concerns, or other reasons within the Client's control, Waste Clearance Barnes may treat the booking as cancelled and charge a call-out or cancellation fee.

6.4 Waste Clearance Barnes may cancel or reschedule a booking due to circumstances beyond its control, including but not limited to severe weather, vehicle breakdown, staff illness, accidents, or legal or regulatory requirements. In such cases, the Client will be offered an alternative appointment time. Waste Clearance Barnes will not be liable for any consequential loss arising from such cancellation or rescheduling.

7. Waste Types and Prohibited Materials

7.1 Waste Clearance Barnes can remove most non-hazardous household and commercial waste, subject to volume and weight limitations.

7.2 Certain materials are classed as hazardous or controlled waste and may be subject to special handling, separate pricing, or refusal. Examples include, but are not limited to, asbestos, chemicals, solvents, oils, gas bottles, clinical waste, and certain electrical items containing hazardous components.

7.3 The Client must declare any hazardous or potentially hazardous materials in advance. Waste Clearance Barnes reserves the right to refuse to remove such items or to adjust the price and service conditions accordingly.

7.4 If hazardous or prohibited materials are discovered during the provision of Services that were not previously disclosed, Waste Clearance Barnes may suspend or cancel the job and may charge for time spent on Site and any associated costs.

8. Compliance with Waste Regulations

8.1 Waste Clearance Barnes operates in accordance with applicable UK waste legislation and regulations. All collected waste is transported and disposed of or recycled through authorised facilities wherever reasonably practicable.

8.2 The Client acknowledges that waste remains their responsibility until it is collected by Waste Clearance Barnes. Once collected, Waste Clearance Barnes assumes responsibility for ensuring that the waste is managed in compliance with relevant regulations.

8.3 Waste Clearance Barnes may issue a waste transfer note or similar documentation where required by law. The Client agrees to provide any information reasonably required to complete such documentation accurately.

8.4 Where electrical and electronic equipment, metal, or other recyclable materials are collected, Waste Clearance Barnes will aim to recycle or recover as much as reasonably possible, subject to local facilities and economic viability.

9. Liability and Limitations

9.1 Waste Clearance Barnes will exercise reasonable care and skill in providing the Services. However, the Client acknowledges that waste clearance work may involve moving bulky or awkward items in confined spaces and across various surfaces.

9.2 Waste Clearance Barnes will not be liable for normal wear and tear, or for minor cosmetic damage to floors, walls, door frames, or other surfaces that could not reasonably be avoided when removing large or heavy items, provided reasonable care has been taken.

9.3 The Client is responsible for protecting or removing any fragile items, floor coverings, ornaments, or fittings that may be at risk during removal of waste. Waste Clearance Barnes will not be liable for damage to items that should reasonably have been moved or protected by the Client before work commenced.

9.4 Nothing in these Terms and Conditions limits or excludes liability for death or personal injury resulting from negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be limited or excluded.

9.5 Subject to the previous clause, Waste Clearance Barnes shall not be liable for any loss of profit, loss of business, loss of opportunity, or any indirect or consequential losses arising out of or in connection with the Services or these Terms and Conditions.

9.6 Waste Clearance Barnes total aggregate liability to the Client in respect of any claim arising out of or in connection with the Services or these Terms and Conditions shall be limited to the total fees paid or payable by the Client for the specific job to which the claim relates.

10. Client Indemnity

10.1 The Client agrees to indemnify Waste Clearance Barnes against any claims, liabilities, damages, costs, and expenses arising from:

(a) Any breach by the Client of these Terms and Conditions.
(b) Any infringement of third-party rights resulting from the removal of waste that the Client did not have authority to dispose of.
(c) Any incorrect or incomplete information supplied by the Client relating to the waste or the Site.

11. Property and Title to Waste

11.1 Title to the waste transfers from the Client to Waste Clearance Barnes at the point of loading, provided the waste is lawful and capable of being transferred.

11.2 If Waste Clearance Barnes reasonably believes that any items have been mistakenly presented as waste, it may, at its discretion, seek confirmation from the Client before removal. However, ultimate responsibility for identifying items to be removed rests with the Client.

12. Delays and Force Majeure

12.1 Waste Clearance Barnes will use reasonable efforts to attend the Site within any estimated time slot discussed at the time of booking, but such times are estimates only and are not guaranteed.

12.2 Waste Clearance Barnes shall not be liable for any delay or failure to perform any of its obligations where such delay or failure results from events or circumstances beyond its reasonable control, including but not limited to extreme weather, traffic disruption, accidents, acts of God, strikes, or regulatory restrictions.

13. Complaints and Disputes

13.1 If the Client is dissatisfied with any aspect of the Services, they should raise the issue with Waste Clearance Barnes as soon as possible, preferably at the time of service or within a reasonable period afterwards.

13.2 Waste Clearance Barnes will investigate complaints in good faith and aim to resolve any issues promptly and fairly. The Client agrees to provide reasonable cooperation and evidence if requested.

14. Data Protection and Privacy

14.1 Waste Clearance Barnes may collect and process personal data relating to the Client for the purposes of handling enquiries, processing bookings, delivering Services, and administering its business.

14.2 Personal data will be handled in accordance with applicable UK data protection laws. Waste Clearance Barnes will take reasonable steps to keep personal data secure and to prevent unauthorised access or disclosure.

15. Amendments to These Terms

15.1 Waste Clearance Barnes may update or amend these Terms and Conditions from time to time. The version in force at the time of booking will apply to that particular Agreement.

15.2 Any material changes to these Terms and Conditions may be communicated through appropriate channels, but it remains the Client's responsibility to review the current version before making a booking.

16. Severability

16.1 If any provision of these Terms and Conditions is found by a court or other competent authority to be invalid, unlawful, or unenforceable, that provision shall be deemed deleted, and the remaining provisions shall continue in full force and effect.

17. Governing Law and Jurisdiction

17.1 These Terms and Conditions and any dispute or claim arising out of or in connection with them or their subject matter shall be governed by and construed in accordance with the laws of England and Wales.

17.2 The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions, the Services, or the Agreement between the Client and Waste Clearance Barnes.

By proceeding with a booking or allowing Waste Clearance Barnes to carry out any waste clearance or collection, the Client confirms that they have read, understood, and agree to these Terms and Conditions.
